This is gonna cut into the $670 million the company stands to make from the sale of its cell towers… a California court has ruled that Sprint's early termination fees are unlawful, and has ordered it to refund $73 million to its former customers.
“The ruling requires Sprint to pay $18.2 million in cash to those customers that actually paid off Sprint on their early termination fees - the remaining $54.7 million will be credited to customers who were charged the ETF but did not yet pay,” writes Will at IntoMobile.
“Sprint will have about two weeks to come up with a response before a final decision is made in Alameda County, California Superior Court,” writes InformationWeek's Marin Perez.
“The Federal Communications Commission is considering regulating early termination fees on a nationwide basis,” notes Wired's David Kravets. “The FCC is also weighing whether to block class-action lawsuits like the Sprint case. No timetable for a decision has been set.”

The Portuguese alternative telco Sonaecom has reported a second-quarter net loss of EUR6.7 million (USD10.5 million), down from a profit of EUR1.3 million in the year-ago period. Earnings before interest, taxes, depreciation and amortisation (EBITDA) dropped 12% year-on-year to EUR34.6 million thanks to higher operating costs, which rose 16.7% to EUR202.3 million. Service revenues were up 11% at EUR215.1 million, largely due to the acquisition last year of fixed line rivals Oni and Tele2 Portugal. Cellular subsidiary Optimus reported 2.33 million active clients at the end of June, up from 2.15 million a year before.

The South African cellular group Vodacom has confirmed the sale of a 6.25% stake worth ZAR7.5 billion (USD996 million) which is being carried out under Black Economic Empowerment (BEE) regulations. Investors include Royal Bafokeng Holdings, Thebe Investment Corp and Vodacom employees. Private investors from the black community will also be invited to buy shares. Once the deal is completed Royal Bafokeng will hold a 1.97% interest in Vodacom, while Thebe will hold 0.84% and employees and the public will own 3.44%. Vodacom is currently a 50:50 joint venture between Vodafone of the UK and Telkom South Africa. It had 24.8 million subscribers in its domestic market at the end of March.

The Kenyan internet service provider AccessKenya Group has contracted Alvarion for a large-scale mobile WiMAX deployment in the 3.3GHz band. The ISP says it will use the new network to provide high speed wireless internet services for middle and high-end residential users in Nairobi and Mombasa. AccessKenya already offers broadband wireline and wireless services to around 2,200 business users.

The Kazakh cellular operator Kar-Tel has been awarded 1800MHz frequencies to complement its current allocation of GSM-900 spectrum. The firm, a subsidiary of Vimpelcom of Russia, says the new frequencies will be used to improve network capacity and quality in major urban areas. Kar-Tel had 4.78 million subscribers and a 38% market share at the end of March according to TeleGeography’s GlobalComms database.

Romania’s telecoms regulator ANRCTI has revealed that the country’s two newest 3G licensees have complied with the first stage coverage requirements of their concessions. RCS&RDS and Zapp/Telemobil were awarded 3G licences in October 2006. RCS&RDS was required to have coverage of 176 towns and 2,400km of highways by 30 June 2008, while Zapp had committed to having coverage of 19 towns and 1,900km of roads by the same date. By the end of the second stage on 31 December 2009, RCS&RDS is committed to covering an additional 1,400km of highways and Zapp must cover 43 towns and 2,000km of roads. RCS&RDS launched its 3G network in December last year, while Zapp began offering services in June 2008. Two other firms, Vodafone and Orange, both have well-established 3G networks in Romania which were launched in 2005 and 2006 respectively.
